Terms of Service

These Terms of Service govern access to and use of the Net Rentals platform and related services.

These Terms of Service ("Terms") are an agreement between you and Net Rentals governing your access to and use of Net Rentals websites, applications, dashboards, hosted rental websites, customer portals, software, and related services. By creating an account, subscribing to Net Rentals, accessing the platform, or otherwise using the services, you agree to these Terms.

1. The Net Rentals Service

Net Rentals provides software and infrastructure designed to help rental businesses operate and manage rentals.

Depending on the services being used, Net Rentals may provide features for:

  • Rental business websites.
  • Fleet and vehicle management.
  • Availability and direct bookings.
  • Customer accounts and portals.
  • Rental agreements and renter requirements.
  • Identity and eligibility workflows.
  • Payments and security deposits.
  • Pickup and return workflows.
  • Messages and notifications.
  • Post-trip charges and disputes.
  • Business administration and reporting.
  • Testing and sandbox tools.
  • Other rental-related functionality.

Features may vary by account, plan, jurisdiction, configuration, third-party service availability, or stage of product development.

2. Net Rentals' Role

Net Rentals provides software and technology infrastructure. Unless expressly stated otherwise, Net Rentals is not the rental business, vehicle owner, renter, insurer, lender, payment-card issuer, or party providing the rented vehicle.

The rental business is responsible for the underlying rental transaction and its relationship with its customer.

Rental agreements, rental policies, vehicle condition, vehicle availability, customer eligibility, insurance requirements, pricing decisions, charges, refunds, deposits, and fulfillment of a rental remain the responsibility of the applicable rental business except where a written agreement expressly states otherwise.

3. Eligibility

You may use Net Rentals only if you are legally capable of entering into a binding agreement and your use of the platform is permitted under applicable law.

If you use Net Rentals on behalf of a company, rental business, or other organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts and Account Security

You must provide accurate and current information when creating and maintaining a Net Rentals account.

You are responsible for:

  • Maintaining the confidentiality of account credentials.
  • Using accounts only as authorized.
  • Managing access granted to employees or other users.
  • Removing access when it is no longer appropriate.
  • Promptly notifying Net Rentals of suspected unauthorized access.

You are generally responsible for activity conducted through your account by users you authorize.

5. Rental Business Responsibilities

Rental businesses using Net Rentals are responsible for their own business operations and legal compliance.

This includes responsibility for matters such as:

  • Ownership or lawful control of vehicles offered for rent.
  • Vehicle maintenance, condition, safety, and registration.
  • Business licenses and permits.
  • Insurance requirements.
  • Rental agreements and policies.
  • Eligibility and driver requirements.
  • Prices, fees, taxes, deposits, refunds, and charges.
  • Customer disclosures.
  • Vehicle pickup and return.
  • Handling customer complaints and disputes.
  • Compliance with consumer-protection and rental laws.
  • Compliance with privacy and communications laws.

Net Rentals does not provide legal, tax, accounting, insurance, or regulatory advice.

6. Rental Transactions

A rental booked through a Net Rentals-powered website or platform is generally a transaction between the customer and the applicable rental business.

The rental may be governed by additional terms provided by the rental business, including its rental agreement, cancellation policy, insurance requirements, deposit policy, mileage rules, fuel policy, late-return policy, and other rental conditions.

Customers are responsible for reviewing and complying with the terms applicable to their rental.

7. Subscriptions, Fees, and Billing

Certain Net Rentals services require payment of subscription, platform, transaction, or other fees.

Applicable pricing will be presented through Net Rentals or otherwise agreed to in writing.

Transaction and service fees

Net Rentals may introduce a platform, service, or transaction fee of up to 2.5% on eligible transactions processed through the platform.

A Net Rentals transaction or service fee will apply only when it is enabled for the applicable transaction. Any such fee will be clearly disclosed before payment and included in the total amount presented before the transaction is completed.

Unless expressly shown during checkout, no Net Rentals transaction or service fee is being charged solely because this provision appears in these Terms.

By purchasing a paid service, you authorize applicable charges according to the pricing and billing terms presented at the time of purchase.

Auto-renewal and cancellation

Unless otherwise specified, paid subscriptions automatically renew for successive periods matching the initial term. You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of the current billing cycle.

Collection and amounts owed

Net Rentals reserves the right to collect unpaid fees or amounts owed under these Terms. We may retry failed payments on file or utilize other lawful collection mechanisms where appropriate.

Subscription access

Access to paid platform functionality may depend on an account remaining in an eligible billing status.

If payment fails, a subscription expires, or an account otherwise falls out of an eligible billing state, Net Rentals may limit access to paid functionality while continuing to provide access to account or billing controls where appropriate.

Pricing changes

Net Rentals may change pricing for future billing periods. Where required, notice of material pricing changes will be provided before the change takes effect.

8. Customer Payments, Deposits, and Charges

Net Rentals may provide software that allows rental businesses to accept rental payments, secure deposits, issue refunds, collect authorized post-trip charges, or otherwise manage financial activity relating to rentals.

Payment processing may be performed by third-party payment providers. Their terms and policies may apply to payment processing activity.

The rental business is responsible for the legitimacy and accuracy of amounts it charges, refunds, captures, releases, or otherwise processes through the platform.

Net Rentals may maintain transaction status and related records necessary to operate payment workflows but is not a bank or card issuer.

Chargebacks, reversals, and negative balances

The rental business is fully responsible for chargebacks, refunds, reversals, and disputed transactions initiated by its customers. Depending on the payment integration structure and applicable third-party processor agreements, if a customer disputes a charge or a reversal occurs, you may owe the disputed amount plus any applicable dispute fees.

Net Rentals reserves a broad right of offset. This means we may deduct owed amounts, negative balances, or dispute fees from your current or future payout balances, or charge your payment method on file to recover such funds.

Taxes

The rental business is solely responsible for determining, collecting, reporting, and remitting any applicable sales, use, rental, vehicle, or other taxes arising from its rental transactions. Net Rentals does not collect or remit taxes on behalf of rental businesses.

Dormant accounts and unclaimed property

Net Rentals may handle dormant accounts, uncaptured deposits, or unclaimed payout funds in accordance with applicable state unclaimed property laws, which may require reporting and remitting such property to the relevant jurisdiction after a statutory dormancy period.

9. Email, SMS, and Communications

Net Rentals includes tools that may allow Net Rentals and rental businesses to send operational communications concerning accounts, reservations, payments, deposits, verification, pickup, return, charges, disputes, support, and other rental activity.

Users of those tools are responsible for obtaining any consent required by law and for respecting applicable communication preferences and opt-out requests.

SMS message frequency varies. Message and data rates may apply.

10. Data and Content

You retain ownership of content and business information you provide to Net Rentals, subject to rights belonging to customers, third parties, and applicable law.

You grant Net Rentals permission to host, store, reproduce, transmit, process, display, modify for technical purposes, and otherwise use that content as reasonably necessary to:

  • Provide the service.
  • Operate hosted websites and interfaces.
  • Process rentals and transactions.
  • Maintain and secure the platform.
  • Provide support.
  • Comply with legal obligations.
  • Improve Net Rentals.

You represent that you have the rights and permissions necessary to provide information and content you submit to the platform.

Identity verification and sensitive information

Certain rental workflows may require identity, eligibility, fraud-prevention, or security verification. These workflows may involve personal information such as government-issued identification documents, photographs, selfies, video or liveness captures, document information, verification results, device information, and other information used to verify identity or prevent fraud.

Net Rentals may use third-party identity verification providers to perform some or all of these checks. Depending on the configuration of the service, Net Rentals may receive, process, store, or maintain verification results, audit records, submitted materials, or references to verification media as reasonably necessary to operate the rental and verification workflow.

Additional information regarding the collection, use, retention, sharing, and deletion of identity and verification information is provided in the Net Rentals Privacy Policy and may also be presented at the time verification is requested.

Payment information

Payment-card processing is provided through third-party payment processors. Sensitive payment credentials, such as complete card numbers and card security codes, may be collected directly by the applicable payment processor rather than by Net Rentals.

Net Rentals may nevertheless receive and maintain limited payment information and transaction records necessary to operate the service, such as payment identifiers, transaction status, payment method type, card brand, partial card information, expiration information, refunds, disputes, deposits, and related financial records.

Our handling of personal information is also governed by the Privacy Policy .

11. Net Rentals Intellectual Property

Net Rentals, including its software, source code, interfaces, designs, documentation, branding, logos, systems, and related materials, is protected by intellectual-property and other laws.

Except for the limited right to use the service under these Terms, no ownership rights in Net Rentals intellectual property are transferred to you.

You may not copy, sell, license, distribute, create unauthorized derivative works from, or commercially exploit Net Rentals technology except as expressly permitted by Net Rentals or applicable law.

12. Acceptable Use

You may not use Net Rentals for unlawful, fraudulent, abusive, deceptive, harmful, unauthorized, or security-compromising purposes.

The Acceptable Use Policy forms part of these Terms.

13. Third-Party Services

Net Rentals may rely on or integrate with third-party services relating to infrastructure, payment processing, communications, identity verification, electronic agreements, advertising, analytics, domains, and other functions.

Third-party services may be governed by separate terms and privacy policies.

Net Rentals does not control every aspect of third-party services and cannot guarantee their uninterrupted availability or performance.

14. Changes to the Service

Net Rentals is actively developed.

We may add, modify, replace, limit, suspend, or discontinue features as the platform evolves.

We may also make changes necessary for security, reliability, legal compliance, third-party integration changes, or other operational reasons.

15. Suspension and Termination

Net Rentals may suspend, restrict, or terminate access when reasonably necessary because of:

  • Nonpayment.
  • Material violation of these Terms.
  • Violation of the Acceptable Use Policy.
  • Fraud or suspected fraudulent activity.
  • Security threats or unauthorized access.
  • Unlawful activity.
  • Risk to customers, businesses, Net Rentals, or third parties.
  • Legal or regulatory requirements.

Where practical and appropriate, Net Rentals may provide notice or an opportunity to resolve the issue before permanent termination.

You may stop using Net Rentals subject to any applicable subscription, payment, record-retention, or contractual obligations.

16. Availability and Maintenance

Net Rentals works to maintain a reliable service, but continuous or uninterrupted availability is not guaranteed.

Service may occasionally be affected by maintenance, software updates, infrastructure problems, third-party provider failures, internet conditions, security events, or circumstances outside Net Rentals' reasonable control.

17. Disclaimers

To the maximum extent permitted by applicable law, Net Rentals and its services are provided on an "as is" and "as available" basis.

Except for warranties expressly provided in a separate written agreement, Net Rentals disclaims warranties that may otherwise arise by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such disclaimers are permitted.

Net Rentals does not guarantee:

  • That every feature will always be available.
  • That the service will be uninterrupted or error-free.
  • That every rental transaction will be successful.
  • That a renter or rental business will perform its obligations.
  • That a vehicle is safe, lawful, insured, or fit for a particular use.
  • That a third-party service will remain available.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Net Rentals will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the use of or inability to use the service.

This may include loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings, even if Net Rentals has been advised that such losses are possible.

To the maximum extent permitted by law, Net Rentals' total aggregate liability for all claims arising out of or relating to these Terms or the service will not exceed the greater of one hundred U.S. dollars ($100.00) or the amounts you paid to Net Rentals in the twelve (12) months immediately preceding the event giving rise to the claim.

Any additional liability limitations applicable to a particular account may be stated in a subscription agreement, order form, enterprise agreement, or other written agreement.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

19. Indemnification

To the extent permitted by applicable law, a rental business using Net Rentals agrees to defend, indemnify, and hold harmless Net Rentals and its affiliates, officers, employees, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

  • The rental business's vehicles or rental operations.
  • Its relationship with customers.
  • Content or information it provides.
  • Charges, refunds, deposits, or policies it establishes.
  • Its violation of law.
  • Its violation of these Terms.
  • Its infringement of another party's rights.

20. Feedback

Users may provide ideas, suggestions, comments, feature requests, or other feedback concerning Net Rentals.

You grant Net Rentals permission to use feedback without restriction or compensation to you, provided that this does not transfer ownership of confidential business information or personal information submitted for another purpose.

21. Changes to These Terms

Net Rentals may update these Terms as the platform, business, or legal requirements change.

The “Last updated” date at the top of this page identifies the most recent revision.

Where required by law or appropriate for a material change, additional notice may be provided.

Continued use of Net Rentals after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

22. General Terms

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Net Rentals' failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without Net Rentals' consent where consent is required. Net Rentals may assign these Terms as part of a merger, acquisition, reorganization, financing, sale of assets, or other business transaction.

Additional written agreements between Net Rentals and a customer may supplement these Terms. If a directly applicable written agreement conflicts with these Terms, that agreement will control to the extent of the conflict.

23. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Informal resolution

Before initiating any formal dispute or arbitration proceeding, you agree to contact Net Rentals informally to attempt to resolve the issue. We will also attempt to resolve disputes informally with you before initiating formal action.

Binding arbitration

You and Net Rentals agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service will be resolved by binding, individual arbitration, rather than in court.

Class action and jury trial waiver

You and Net Rentals waive any right to a jury trial or to participate in a class action, class arbitration, or representative proceeding. The arbitrator may award relief only on an individual basis.

Small claims exception

Notwithstanding the arbitration requirement, either party may bring a qualifying individual claim in small claims court if the claim is within that court’s jurisdiction and proceeds on an individual basis.

Mass arbitration procedures

If a mass arbitration process is initiated involving a coordinated group of claims, specific batching procedures, administrative rules, and fee allocations will apply as determined by the arbitration administrator to efficiently manage the volume of claims.
